General terms and conditions for the rental of the property “bambisbasecamp”
§ 1 Scope
These general terms and conditions apply to contracts for the rental of the property “bambisbasecamp” for accommodation purposes and to all further services provided to the guest in this connection.
§ 2 Contracting party
The contracting party is:
Stephan KorteOesigweg 46
38889 Blankenburg
Deutschland
§ 3 Conclusion of the contract
- The presentation of the property on the website does not yet constitute a binding offer to conclude a contract.
- By making a booking request or a booking, the guest makes an offer to conclude an accommodation contract.
- The contract is only concluded when the landlord confirms the booking in writing or in text form, e.g. by email.
- Insofar as a deposit has been agreed, the booking confirmation may provide that the contract or the reservation is only maintained if the deposit is received on time.
- For a booking with online payment, the website keeps the selected period available for payment: 60 minutes after the booking and, in the case of a payment request from the landlord, 48 hours, in each case until the end of the day of arrival at the latest. A payment started by then can still be completed. If the payment is not completed, the period is released again and no contract is concluded; any payment received after that will be refunded.
§ 4 Services
- The landlord provides the guest with the booked property for the agreed period.
- The scope of the contractual services is determined by the booking confirmation and any agreements made in the individual case.
- There is only an entitlement to the provision of certain additional services if these have been expressly agreed.
§ 5 Prices and terms of payment
- The prices agreed at the time of booking apply.
- Unless otherwise agreed, the total price is to be paid in accordance with the payment deadlines stated in the booking confirmation.
- Payments can be made using the payment methods offered on the website. Stripe may be used to process payments.
- In the event of late payment, the landlord is entitled to claim default interest and further damage caused by the delay in accordance with the statutory provisions.
- The total price shown includes the final cleaning.
- A tourist tax (Kurtaxe, also known as Kurbeitrag or Gästebeitrag) is not included in the total price; if the municipality levies it, it is payable on site. Details are listed with the property.
§ 6 Arrival and departure
- The property is available to the guest on the day of arrival from 15:00.
- On the day of departure, the property must be vacated by 10:00 at the latest and handed over swept clean.
- Different times require an express agreement.
§ 7 Use of the property
- The property may only be used by the number of persons stated in the booking confirmation.
- The maximum occupancy is determined by the agreed booking.
- The guest undertakes to treat the property and its contents with care.
- The guest must report any defects, damage or malfunctions without delay.
- The guest is not entitled to pass on the property to third parties or to sublet it, unless this has been expressly permitted.
§ 8 Pets
- Pets may only be brought along if this has been expressly agreed.
- The guest must ensure that animals brought along do not cause any disturbance, danger or damage.
- The guest is liable for damage caused by pets in accordance with the statutory provisions.
§ 9 Withdrawal by the guest / cancellation
- The guest may withdraw from the booking at any time before the start of the stay.
- The withdrawal should be made in text form. The time at which the landlord receives the declaration of withdrawal is decisive.
- In the event of withdrawal, the landlord may claim flat-rate compensation for the expenses incurred and the loss of profit. The cancellation fees are as follows:
- up to 45 days before arrival: 20% of the total price
- 44 to 30 days before arrival: 40% of the total price
- 29 to 14 days before arrival: 80% of the total price
- from 13 days before arrival, in the event of no-show or early departure: 100% of the total price
- The guest remains entitled to prove that the landlord has incurred no damage or significantly less damage.
- In the event of a cancellation, the landlord will endeavour to let the property to someone else. If the property is let to someone else, any resulting benefits will be credited.
§ 10 Withdrawal / termination by the landlord
- The landlord may withdraw from the contract or terminate it for good cause if
- agreed payments are not made despite a deadline having been set,
- force majeure or other circumstances for which the landlord is not responsible make it impossible to perform the contract,
- the guest uses the property contrary to the agreement in a manner that substantially breaches the contract,
- the guest persistently disturbs the peace of the house or
- the property is damaged intentionally or through gross negligence.
- In the event of a justified withdrawal by the landlord, payments already made will be refunded, provided there are no counterclaims.
§ 11 Liability
- The landlord is liable in accordance with the statutory provisions for damage resulting from injury to life, body or health.
- For other damage, the landlord is only liable in the event of intent and gross negligence, unless material contractual obligations are breached. In the event of a slightly negligent breach of material contractual obligations, liability is limited to the foreseeable damage typical of the contract.
- The limitations of liability do not apply insofar as mandatory statutory provisions preclude them.
- The statutory provisions apply to items brought in by the guest.
§ 12 Obligations of the guest / compensation for damage
- The guest is liable in accordance with the statutory provisions for all damage to the property, its contents or the grounds caused by the guest, their fellow travellers or visitors.
- Damage and defects must be reported to the landlord without delay.
- If keys or other means of access are lost, the guest may be obliged to reimburse the resulting costs.
§ 13 House rules
- The house rules of the property form part of the accommodation contract.
- The guest undertakes to comply with the house rules.
- In the event of serious or repeated breaches, the landlord may terminate the contract for good cause.
§ 14 No statutory right of withdrawal
For contracts for the provision of accommodation for a specific date or period, consumers generally have no statutory right of withdrawal. This follows from Section 312g(2) no. 9 BGB (German Civil Code).
§ 15 Data protection
Personal data of the guest is processed exclusively within the framework of the statutory data protection provisions. Further details can be found in the privacy policy on the website.
§ 16 Final provisions
- The law of the Federal Republic of Germany applies.
- If the guest is a merchant, a legal entity under public law or a special fund under public law, or has no general place of jurisdiction in Germany, the place of jurisdiction is the registered office of the landlord, insofar as legally permissible.
- Should individual provisions of these terms and conditions be or become invalid in whole or in part, the validity of the remaining provisions shall remain unaffected.
